History, Background, Thoughts and Legal Considerations_LifeLong Learner

Being a lifelong learner dedicated to the pursuit of knowledge for personal and professional reasons I would use the information presented to keep from being victimized over the internet by hackers and other computer crimes. Lifelong learner also means keeping up with voting laws and how they are implemented over the computers as I strive to educate myself every day. Over the years scientific and technological innovation and change has had a profound effect on learning needs and styles. Therefore, I must keep abreast of the changes in all tech law especially when dealing with the internet in this ever-changing world. Learning can be seen as something that takes place on an on-going basis from our daily interactions with others and with the world around us. As technology changes we must adapt and learn to meet everyday demands. When you're an active learner on the job, you see challenge things more clearly and are more creative in solving problem as you work smarter.

In our world today there are many crimes committed over the internet. There have been many stories about companies and other government that has been victimized by hacking and other types of computer crimes. Security needs to be changed to protect the voting rights. In today’s world we rely on things like punched cards, voting machines, handwritten ballots, computers and many other methods. Because of this internet voting may need to be made an option rather than a requirement. All systems of voting can be a problem. Nanotechnology is the science of very small things and I mean very small. Like every new technology that preceded it, the development of the law surrounding nanotechnology is well behind the advances in the technology. Nanotechnology Website and software development has again become affordable. The point is that from the client's perspective it's not about the law, it's about business. When you use your lawyers properly and they do their job, it's about mitigating risk, solving business problems, and making money. Entrepreneurial is the nature of the beast because of the personality type technology attracts. Equity investments can change this because cash-strapped business still offer law firms stock in exchange new, unique, and hard-to-duplicate technologies and ideas. VCs are looking for new, unique, and hard to duplicate technologies. Tech deal take time and no one should wait minute to make a deal.

Negotiations: Policies, Procedures, and Suggestions_Change Agent

As a Change Agent”, I would use what I learned in this chapter on how you will use what you learned from this chapter about Negotiations: Policies, Procedures, and Suggestions” and make changes in your workplace environment. A change agent is critical to the success of a change in any program. Skills include developing people outside of their normal functional boundaries, motivating them, and communicating solutions. Acting as a change agent I would show coworkers how trends have changed could help make a change and stick with it. This could help them focus and implement change needed to build a great negotiating team that would help the company succeed. Most people change for the better when they realize the change is better for the workplace and everyone concerned. The world around us is changing every day. If you have what it takes to make changes within a company, and a vision for others to follow, then our successes will soon be seen as great Leadership.

Negotiations: Policies, Procedures, and Suggestions_Refelection

Negotiation is a discussion between two or more disputants who are trying to work out a solution to their problem. Negotiations usually take place because the parties want to create something new that neither of them can do on their own. The parties will acknowledge that there is a conflict of interest between them and think they can use some form of influence to get a better deal. In negotiation “information is powerful”. You should ask open-ended questions and listen to what is being said. The more you listen the more you learn. To improve your negotiation skills you should start by preparing, develop a good game, plan, listen, and talk very little. Sometimes it is better to drop the big idea first. When negotiating you should never forget that you are negotiating more than money. Negotiating telephone deals by phone are good for things that are not that important. Deals that are important should be made important. Negotiating tech deals can lead to disputes and when they do law- suits follow. When parties negotiate, they usually expect give and take. The disputants will either attempt to force the other side to comply with their demands. When negotiating as a team, team members should never disagree with each other. You can also consider outsourcing technology as an effective cost cutting measure. When building a team, the first thing to do is to create an exploratory team and let the team investigate. A team leader should be chosen to do all the talking. Then you should begin building the team with members who understand the company. The team should also include outside advisors who can give objective advice. A tech lawyer should be kept on the team and finally, if the "right" people are not involved in negotiations, the process is not likely to succeed. All the interested and affected parties must be represented negotiators must truly represent and have the trust of those they are representing. If constituents do not recognize a negotiator as their legitimate representative, they can try to block implementing the agreement. Negotiators must be sure to consult with their constituents to ensure that they adequately deal with their constituents' concerns.

Privacy, Policy, and Encryption_Change Agent

Working as a change agent I would get everyone involved in learning about “Privacy, Policy, and Encryption”. This is something that affects everyone because these policies concern anyone who uses the internet. Everyone wants what they use in e-mails and messages to be private or to be sent to who it was intended for. This is the why everyone should get involved and as a change agent it is my job to share what these polices mean and why they are important to internet users. Everything is done on the internet in this day and age, from messaging to buying and purchasing and the use of credit cards. Credit card security, one of the biggest frauds, has changed in many ways since the beginning of using them via internet. Credit card fraud is one of the privacy that has been invaded over the internet and there is a need to change the way people use them for protection. Educating very one about how to avoid fraud would help change the way card users protect themselves when they think about the words privacy, policy, and encryption. This change could get everyone involved and make doing business online easy for all because they know the law.

When it comes to the internet, protecting your privacy is a very big problem for all of us. We all rely on our computers daily to perform for us and give us information to live by and most of the time the information is very critical information that is stored on our hard drives. So for this reason, the important information is available and secure at the same time. People must do what is necessary to keep this information secure.Encryption is that best way to protect important information when a computer involved. It involves the taking of the data and putting into a descrambling code so that no one can figure it out what it is. In addition to encryption we must protect ourselves from the internet with privacy policies. According to Grossman, two of the most popular policies are” the Gamma-Leach-Bliley Act and The Health Insurance Probability Act.”Grossman, M. (2009) The GLB Act protects the financial information of company’s clients and the Health Insurance Probability Accountability Act protects the information of individuals’ medical privacy.

A change agent must understand people and change is about people. If you change everything but the people, then there is doubt you'll be effective as a change agent. Change is hard work and it takes a lot of energy. The change agent needs to come to work every day and risk being misunderstood. Living in the future a change agent has a vision of what could or should be. Working as a change agent I would make a change and try to make it stick. When people change they usually change for the better because no one stays the same. Educating people in my work place about “Piracy and Crime: Schemes and Scams” will be hard to do because it is so easy to misuse computers and software. My job would be to help them understand the rules and the laws that govern the use of computers and the software they use on the internet.

Piracy and Crime: Schemes and Scams_ Reflection

Piracy and Crime: Schemes and Scams There are legal approaches that have been developed throughout the history of the Internet to address the different types of Internet crime. These Internet crimes include penalty for using unlicensed software. To prevent this problem one of the most important step is preventing software theft and copyright infringement. Computer crime is any illegal activity that is comes through the use of a computer. Employees should be educated about software privacy. Using Metering software can help track the use of software. A server software license should also be used to allow a number of users to connect to the network. The BSA can view unauthorized use of software as stealing someone else’s property. Cyberbullying similar to cyberstalking is described as continued harassment and torment with the use of an electronic communications device, most often via the Internet. The main difference is that cyberbullying involves adolescents as victims and/or offenders. Cyberbullying is now being prosecuted under the harassment statutes. It involves stalling online. It involves using the internet, its e-mail, the chat room and the other types of electronic communications to stalk another person. Pretexting also breaks the law. This is uncovering hidden financial information about people under false pretenses is called pretexting. Online investigators who use pretexting are breaking the law. There is very little protection of this in the U.S. The best thing to do is to educate you about privacy issues. Spyware can be installed for free to protect your computer. Websites and e-mails can be bugged. This is called web bugs a tool for gathering information. Web bugs are an asset to spammers because it lets them know if you e-mail is valid. The bottom line is that nobody should use the internet to collect information from web pages.

Employees’ Rights, Obligations Pitfalls in Litigation_“Lifelong Learner ”

A lifelong learner means that I am in the pursuit of knowledge for personal and professional reasons. Lifelong learners are always open for new ideas and ever changing learning opportunities in the world today. Because the world and everything in life is always changing, so learning should continue to change in needs and styles and should always be on-going. What I have learned about “Employees’ Rights, Obligations Pitfalls in Litigation” in this chapter can really make a change in my workplace if everyone commit to these new ideas that has changed in the law in today’s world. The world is changing and becoming a lifelong learner means changing the way they look at their rights at the workplace. Employees should follow the rules at work the same as they do for their home and other public places. Rules are made to keep the law and order everywhere and without rules and law the world would not be fit to live in. Following the rules and office etiquette will make it a great place to work for everyone. As a lifelong learner I would use what I have learned from this chapter and make changes in my workplace environment by remembering that the office is for work and when using the computer use online etiquette because the computer belongs to the company not me. I am obligated to do the work I was hired for and following the rules in the office is part of my job as an employee. I know that the company has priority when it comes to monitoring the office and the way I behave while working and using equipment to do my work. Laws and rules are there to protect both employees and the employer. Learning is here to stay, so learning how to work in an office and use online and e-mail etiquette is a must in today’s world. Workshops can also be used to evaluate the quality of the information and organize it so it can be used effectively to create a more innovated learning environment for students. If you know you have a problem, meet with employees and make sure they understand such conduct will result in disciplinary action if it continues. I understand and know that everyone needs to be concerned with and know abut morality, ethics, and employee morale.

Employees’ Rights, Obligations Pitfalls in Litigation_ Reflections

Our workforce cans create challenges for employers in managing employee relations. The way an employer respond to and investigate internal complaints of things like harassment, discrimination and other misconduct and allegations can have a very serious impact legally. The company is one who should be in charge of the way the office and the way employees behave in the workplace. The computers are the property of the company and that is why its employees should not do anything improper when using the company’s computers. Using E-mail etiquette is very important in the workplace. This is a very convenient way to talk to someone who may not want to be disturbed by telephone. This is also a way to make mistakes by sending e-mails that are inappropriate or even personal to be read by others for one reason or another. E-mail should not be used for personal use in the office. When working in an office, you represent the office and online laws apply online and off line. Also, when surfing the internet we should be careful not to go to adult online site that violate company’s rules. Employees should not visit popular site like face-book and eBay during office hours and on the company’s computer. Work and the social network should remain separate in the office for many reasons.

A change agent lives in the future and not the past because they have a vision of what they want to see happen in the world around them. A change agent tries to inspire what they feel in others. Getting people to change is very hard when they are so use to doing things the old way. A change agent must be very strong in what they believe in to make others change too because they not only must make the change but must have the courage and be willing to do what is best for the community or work place. Acting as a change agent about development and upkeep, laws, issues, and solutions in websites can be a challenge in many ways. Working as a change agent I would get the person creating the website to follow the ten step mentioned and get them to change the way the way they look at creating a website. My goal is to get then to consider all the issues and concerns about creating a website and to make them aware that others in our workplace and community should be aware of the issues. This change could get everyone involved and thus solve the problem of someone getting sued for lack of knowledge about creating a website without issues with the law. As a change agent I would be the voice to help educate others and getting others involved would help implement change and help people succeed in the world around them.

Websites: Development and Upkeep, Laws, Issues, and Solutions_ Reflections

Websites: Development and Upkeep, Laws, Issues, and Solutions A functional web site has become a necessity for law firms and legal organizations. The process of developing a web site is sometimes a waste of time wasted time. As you prepare to build your first web site it is vital that you understand the whole process from beginning to end. This will allow you to make better decisions in the technologies you choose to implement and the people you hire to handle the site's development. There are ten things that everyone should consider. Be sure you have a written agreement from the person who created it if you hired someone to create your site. The second concern is exposing you to the business world and being sued. The third thing to consider is privacy issues and concerns The fourth concerns is framing and linking. Linking is when a surfers clicks on part of your website and is taken to another website. Framing is when you have a link that changes only part of the browser display. The fifth concern is your web wrap agreement. The sixth concern is whether or not you are infringing on someone else’s copyright. The seventh concern is trademark laws and how they apply online. The eighth concern is that you should register your copyright and trademark. The ninth thing to consider is advertising, consumer protection, and product liability laws Last but not least you should concede having a backup procedure for your website.

Webwrap A web-wrap agreement is an agreement to abide by the terms of a license agreement signified by downloading the software, data or content to which the license agreement applies. Framing Frames are used to subdivide web pages into multiple parts. In most cases, frames are used only to show multiple pages of content from the same site at the same time. Organization A company that is ran by a group. Content A subject with information. Agreement A contract on paper Murkey Not understood

Managing IT and Software_“Reflective Practitioner”

As a “Reflective Practitioner” I would use what I have learned from this chapter and make changes in my workplace environment by looking at the work I do, and the work process, and considers how I can improve. We all should be a ‘reflective practitioner because we learn from our experiences and mistakes. I would look at what I am doing and how others are doing the same thing and see if I can improved the way I manage IT and software. The information given in this chapter about license software and developing business is very clear and has changed the way I look at software in the workplace.

Managing IT and Software_ Refelection

Managing IT and Software I learned that when managing IT and software one methodology to consider is called joint application development. This development takes end users, executives, tech lawyers, and developers off-site, and way from distractions for meetings where they work out the details of what the developers will create. This way the focus is on the business objectives rather than the programming details. The most important aspect to remember with joint application development is that it requires the top executives to be very involved in the planning process. The chapter also talks about project scope creep. This is when you feel like you are never going to finish a project and your outsourced tech project never stops growing. Scope creep is the growth or change in your project that happens while you’re working on the project. You also need to define the beginning of the solution carefully. The best agreement for tech projects will include a change order procedure which the project scope is supposed to change. A good change order procedure also involves a written request for a change. A good tech lawyer will impose discipline during implication. When you license software you, you receive an object code that only your computer can read and humans write programs using source codes. The source codes are human readable codes and software developers consider the source code to be their most valuable trade secret. A source code is the lifeblood of the software developing business. A source code escrow is when you deposit any other information with a neutral third party. There are many ways to set up an escrow and depends on how much you want to invest. A savvy litigant usually add tech attorneys who specialize in e-discovery to handle electronic evidence As a “Reflective Practitioner” I would use what I have learned from this chapter and make changes in my workplace environment by looking at the work I do, and the work process, and considers how I can improve. The Law: Technology, Copyright, and Intellectual Property _ Change Agent

The  Law: Technology, Copyright, and Intellectual Property

Tech law is the way that technology or the internet has come into our life and changed it. The internet and technology has brought many changes in our life.  Federal and state laws protect our music, writing, and other property that we create.  They are called “intellectual property” law, and they include copyright, trademark, and our patent laws that are for various situations with each having its own set of technical rules.
When we use the creative work of others we should be concerned with copyright law.  Privacy right is used when someone’s work is used.  Below is a summary of the various types of intellectual property laws.

  • Copyright. Original creative works such as paintings, writing, architecture, movies, software, photos, dance, and music are protected by federal copyright law.
  • Trademark. Brand names such as Nike and Avis that identify and distinguish products and services, are protected under federal and state law.
  • Right of Publicity. The image and name of a person are protected under a patchwork of state laws known as the right of publicity.
  • Trade Secrets. State and federal trade secret laws protect sensitive business information.
  • Right of Privacy. Privacy laws preserve the right of all people to be left alone.

As a change agent I would be the voice to help educate others about the special laws that govern the internet when using the creative work of others in the workplace.   Continuous collaboration with my colleagues, co-workers, and other people in my community will create and maintain learning environments that assure academic development.  Getting others involved in helping would implement change would help people succeed when they interact with the internet using technology laws.

Contracts and Contracting: Law, Issues, and Tips_ Life Long Learner

Technology law requires you to have the ability to apply today’s legal concepts to tomorrow’s emerging technologies. Attorneys must have experience negotiating and drafting simple and complex technology.  The  reason why you should use contracts is to coordinate independent actions in situations of multiple equilibria. Another reason for using contracts is to implement exchanges that depend on future events. In the insurance context, the transaction is motivated by the insured’s risk aversion.
Contracts can also be useful in situations of hidden information.  Normative discussion relating to contract law revolves around the issue of freedom of contract.  As a Lifelong Learner who is always learning and building knowledge to help myself grow professionally, my goal is to gain knowledge that can use throughout my  life.
