Negotiations: Policies, Procedures, and Suggestions_Refelection
Negotiation is a discussion between two or more disputants who are trying to work out a solution to their problem. Negotiations usually take place because the parties want to create something new that neither of them can do on their own. The parties will acknowledge that there is a conflict of interest between them and think they can use some form of influence to get a better deal. In negotiation “information is powerful”. You should ask open-ended questions and listen to what is being said. The more you listen the more you learn. To improve your negotiation skills you should start by preparing, develop a good game, plan, listen, and talk very little. Sometimes it is better to drop the big idea first. When negotiating you should never forget that you are negotiating more than money. Negotiating telephone deals by phone are good for things that are not that important. Deals that are important should be made important. Negotiating tech deals can lead to disputes and when they do law- suits follow.
When parties negotiate, they usually expect give and take. The disputants will either attempt to force the other side to comply with their demands. When negotiating as a team, team members should never disagree with each other. You can also consider outsourcing technology as an effective cost cutting measure. When building a team, the first thing to do is to create an exploratory team and let the team investigate. A team leader should be chosen to do all the talking. Then you should begin building the team with members who understand the company. The team should also include outside advisors who can give objective advice. A tech lawyer should be kept on the team and finally, if the "right" people are not involved in negotiations, the process is not likely to succeed. All the interested and affected parties must be represented negotiators must truly represent and have the trust of those they are representing. If constituents do not recognize a negotiator as their legitimate representative, they can try to block implementing the agreement. Negotiators must be sure to consult with their constituents to ensure that they adequately deal with their constituents' concerns.
